ReadMr. Mortell is the firm’s Co-Managing Partner, Chair of the Healthcare practice group, and a member of the Construction practice group. His healthcare practice focuses on advising hospitals and other healthcare providers on all aspects of healthcare law, including COVID-19. He assists the providers in business transactions, including the acquisition of competing entities, the formation of entities or facilities jointly owned by hospitals and physicians, the acquisition of physician practices, and professional services contracts between hospitals and physicians. Additionally, he advises hospital boards on physician integration, compliance, governance, and strategic planning issues.
Mr. Mortell has represented hospital clients in federal False Claims Act litigation, payer reimbursement claims, and related compliance matters. He represents and advises hospitals and other healthcare clients on physician peer review, credentialing, and discipline issues. He also advises healthcare clients on issues related to compliance with HIPAA, EMTALA, and fraud and abuse regulations at both the state and federal levels.
His construction practice focuses on construction-related litigation, arbitration, and mediation. He represents project owners, contractors, subcontractors, and design professionals in large, complex construction projects. Mr. Mortell advises clients at all stages of the construction process, including contract drafting, procurement questions, bid disputes, evaluation, prosecution, defense of contractor claims, mediation, arbitration, and litigation.
