Transactions

Our attorneys offer timely and effective guidance on real estate purchases, sales, and exchanges throughout the Northwest and across the United States. We have navigated many successful closings of complicated transactions for buyers, sellers, and financial institutions and maintain in-depth expertise in handling tax-deferred exchanges of real property interests under Section 1031 of the Internal Revenue Code.

Our real estate team excels in leasing, finance leasing, lease options, and property management concerns. We represent landlords and tenants in negotiation and preparation of leases for retail, industrial, multi-tenant, tax credit, agricultural, and other commercial property transactions. With a wide range of experience in property management legal issues and documentation, we assist with common area maintenance agreements, CC&R administration, compliance and drafting, and repair and replacement issues in real property. Our team is specifically recognized for our legal proficiency in the ongoing operation of business parks and retail shopping centers.

Financing

Our real estate attorneys represent lenders and borrowers in all aspects of real estate financing. We structure and negotiate multi-state, multi-site, and blended real and personal property secured transactions. We have extensive knowledge in real estate backed securities, tax increment financing, and public and quasi-public bonding, including borrower and bond counsel legal opinions. Our team effectively and efficiently represents clients in workouts, foreclosures, bankruptcies, and collections.

Land Use

We have national recognition for our real estate development services, and frequently work with local planning agencies, city councils, county commissioners, and state and federal agencies on behalf of developers, property owners, and investors. We provide early guidance to speed up the approval process and offer persuasive advocacy on appeal or challenge. Representative projects include the development and expansion of shopping centers, office buildings, industrial facilities, and large scale agricultural operations.

Our real estate team can advocate for your rights to develop, use, and enjoy property. We have extensive experience in land use litigation, regulation, and administrative proceedings, having represented clients before cities and counties throughout Idaho and Washington. From applications for rezoning and conditional use permits for individual parcels, to subdivision platting and planned unit development applications, our attorneys provide the assistance needed to make development happen.
