Biography

Ken Howell is a partner in the Business & Finance group and Co-Chair of the firm’s Banking group. His practice emphasizes creditor rights, bankruptcy, banking, intellectual property (including trademark and copyright), and real estate (with a focus on business transactions associated with the technology industry, real estate financing and development, and debtor/creditor relationships).

Mr. Howell’s banking practice has emphasized creditor representation for regulatory compliance, bank deposits and collections, retail branch operations, and procedures and loan documentation. His experience in debtor/creditor relationships includes the creation and documentation of such relationships through secured and securitized transactions, workout of problem loans, resolution of bankruptcy issues, and the collection of delinquent obligations. Mr. Howell has assisted lenders in all aspects of collection of delinquent accounts from unsecured loans through complex commercial agricultural credits involving livestock, real estate, and accounts receivable. In the technology area, he helps clients protect, acquire, license, and transfer copyrights, trade secrets, trademarks, and trade names. These services include drafting of effective agreements to assure ownership and perfection of intellectual property interests, creation of joint development agreements, and the drafting and negotiation of confidentiality, non-compete and non-disclosure agreements and the compliance with federal and state laws regarding privacy of consumer and customer information.

Mr. Howell is experienced in litigation to protect and enforce intellectual property rights and to prosecute infringement of those rights. In the real estate financing and development area, his practice encompasses a broad range of business transactions, including real estate acquisition, financing and development, and representation of clients before local zoning, highway district, and city council hearings.
