Insight CDC Extends Eviction Order Until March 31, 2021

Update to January 4, 2021 Extension of CDC Eviction Order Blog Post

The Centers for Disease Control and Prevention’s (the “CDC”) September 4, 2020, order entitled Temporary Halt in Residential Evictions to Prevent the Further Spread of COVID-19 (the “2020 Order”)[1] has been extended for another two months.

With the recent change in administration, President Biden, via executive order, directed the CDC to extend the 2020 Order a second time. Accordingly, the Director of the CDC, Rochelle Walensky, issued a second order effective January 31, 2021, entitled Temporary Halt in Residential Evictions to Prevent the Further Spread of COVID-19 (the “2021 Order”)[2] extending the 2020 Order and related protections until March 31, 2021. To the extent that there are any conflicts between the 2020 Order and the 2021 Order, the 2021 Order controls.
